Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the New Nörm Platform (“Platform”), provided by Sestive Inc. (“we,” “our,” or “us”). By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Platform.
We are committed to providing a secure, efficient, and user-friendly platform for the users.
1. Acceptance of Terms
By accessing or using the Platform, you agree to these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are accessing the Platform on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years old (or the legal age of consent in your jurisdiction) to use the Platform, or have parental consent if underage. You are responsible for researching and verifying the qualifications, credentials, and licensing of any therapist you choose to engage with on the Platform.
3. Account Registration
To use the Platform, you must create an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- For Users: You must provide accurate contact and health-related information to ensure that your therapy sessions are properly scheduled and conducted.
4. Use of the Platform
- For Users: You may use the Platform to book and attend therapy sessions, access your personal data, and communicate with your therapist. You agree to provide accurate information during your sessions and engage in a respectful manner. Additionally, you are responsible for verifying that the therapist you choose meets your expectations and professional requirements.
5. Payment Terms
- New Nörm is free to use, but we offer optional Pro user packages that unlock additional features and functionality. If you choose to upgrade, a monthly subscription fee will be charged based on the plan you select. All payments are processed securely by Sestive Inc. and apply only to your use of the New Nörm platform.
- New Nörm does not facilitate or manage any therapy session payments. If you are connected to a therapist or coach through the platform, any financial arrangements are made directly between you and that professional. Sestive does not handle or take responsibility for external transactions.
6. Intellectual Property
The Platform and all its content, including but not limited to text, graphics, logos, images, software, and other materials, are owned by New Nörm or its licensors and are protected by intellectual property laws. You agree not to copy, modify, or distribute any content from the Platform without prior written permission from Sestive Inc..
7. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for any breach of these Terms or for any conduct that we believe is detrimental to the Platform or its users.
Your access may be suspended if you engage in harmful behavior or violate the Platform's usage guidelines.
8. Data Privacy and Confidentiality
We take your privacy and confidentiality seriously. For full details on how your personal data is collected, stored, and protected, please refer to our Privacy Policy.
As a user of New Nörm, you are responsible for ensuring that any information you share on the platform—whether personal, emotional, or health-related—is accurate and shared at your own discretion. While Sestive Inc. implements strong safeguards to protect your data, you acknowledge that no online platform can be 100% secure. We encourage mindful use of the platform and full awareness of the personal nature of the content you choose to share.
9. Prohibited Use
You agree not to use the Platform for any unlawful, harmful, or malicious purpose, including but not limited to:
- Distributing viruses, malware, or any other harmful software.
- Impersonating any person or entity or falsely stating or misrepresenting your affiliation with a person or entity.
- Engaging in harassment, abusive behavior, or any activity that could harm or disrupt the use of the Platform by others.
10. Disclaimers and Limitation of Liability
The Platform is provided "as is" without any warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or availability of the Platform. You use the Platform at your own risk.
New Nörm will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to damages arising from lost data, loss of business, or harm caused during therapy sessions, except to the extent required by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Sestive, its affiliates, employees, officers, and agents from any claims, damages, or liabilities arising from your use of the Platform, your violation of these Terms, or your breach of any applicable law or regulation.
12. Changes to the Terms
We reserve the right to modify or update these Terms at any time. Any changes will be communicated through the Platform. Continued use of the Platform after such changes will constitute your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Notwithstanding the foregoing, if you are a resident or user in a jurisdiction where consumer protection laws require a different governing law, such laws will apply to your use of the Platform as required by local law.
14. Dispute Resolution
Any disputes arising from or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration organization. The venue for arbitration shall be Wilmington, Delaware, unless otherwise required by applicable law in your jurisdiction. Notwithstanding the foregoing, nothing in this section prevents you from seeking interim or emergency relief in a court of competent jurisdiction.
